1. By registering as a Spree Member, recommending friends or using the SpreeApp, you agree to abide by our Terms and Conditions and Rules of Use.
1a. If you use Spree App or www.spreebook.com (the ‘Website) you agree to be bound by these terms and conditions.
2. Definitions
In these terms and conditions, ‘we’ and ‘us’ means the Spree App, a trading name of Spree Publications Limited (company number: SC204079), whose registered office is at Spree, PO Box 18784, Aberdeen, AB25 9BU.
3. Formation of agreement
3.1 An agreement for us to sell you membership of the Spree App subscription is made on the basis of these terms and conditions when we accept your order for the Spree App subscription through either of the Websites. (This agreement between us is referred to in these terms and conditions as this ‘agreement’.)
3.2 The description of the Spree App, Spree App subscription, price, currency, VAT, insurance and delivery costs are set out in the order pages.
3.3 Use of all offers on the Websites and contained in the Spree App are subject to the Customer Rules of Use at Annex A of these terms and conditions.
4. Orders
4.1 Orders shall be accepted at our sole discretion but are normally accepted if the Spree App subscription is available, the order reflects current pricing, you are based in a country to which we are currently able to sell and your credit or account card is authorised for the transaction.
4.2 VAT is applied to the price of the App subscription
4.3 The price quoted to you at the time we confirm your order shall remain valid for 14 days from that time. If the price has increased in between the expiry of that period, we will first confirm with you by e-mail that the new price is acceptable before continuing.
4.4 Recommend a Friend Scheme. Rewards will only be awarded once the recommended person has paid for their membership in full and is a brand new member to the Spree App. Any friends introduced that have been a Spree App member in the last 3 years do not qualify for this scheme. We do not accept introductions from the same household or allow individuals to recommend themselves.
5. Acceptance of your order
We will confirm receipt and acceptance of your order through our automatic screen confirmation of the order. If you provide your e-mail address we will also follow this up with a confirmatory e-mail.
6. Access to the Websites, content and app
6.1 The information provided by us on the Websites is not in any way an invitation or recommendation to buy any goods or services featured.
6.2 We will endeavour to allow uninterrupted access to the Websites, but access to the Websites may be suspended, restricted or terminated at any time. We are not responsible for internet interruption or lack of service in a location which may interrupt website or app access.
6.3 We reserve the right to change, modify, substitute or remove without notice any information on the Websites from time to time. We are continually updating the offers available, so changes may be made at any time. We shall use reasonable commercial endeavours to keep the Websites up to date but information and specifications given are for your information only and are subject to change without notice.
6.4 We assume no responsibility for the contents of any other websites to which the Websites have links.
7. Intellectual Property
7.1 The copyright in the material contained in the Websites, together with the Websites’ design, text and graphics, and their selection and arrangement, and all software compilations, underlying source code and software (including applets) belongs to Spree Publications Ltd, its subsidiaries or the providers of such information. All rights are reserved. None of this material may be reproduced or redistributed without our written permission. You may, however, download or print a single copy for your own non-commercial off-line viewing.
7.2 ‘Spree’, ‘Spree Book’, ‘Spree Membership Card’, ‘Spree Funds for the Community’, are trademarks of Spree Publications Ltd. Other product and company names mentioned on these Websites may be the trademarks or registered trademarks of their respective owners.
8. Exclusions of liability
8.1 We use reasonable endeavours to ensure that the data on the Websites is accurate and to correct any errors or omissions as soon as practicable after being notified of them. We do not monitor, verify or endorse information submitted by third parties for posting on the Websites and you should be aware that such information may be inaccurate, incomplete or out of date. To the extent permitted by applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained on the Websites. We do not guarantee that the Websites will be fault free and do not accept liability for any errors or omissions.
8.2 Due to the nature of electronic transmission of data over the internet, and the number of users by whom data is posted on to the Websites, any liability we may have for any losses or claims arising from an inability to access the Websites, or from any use of the Websites or reliance on the data transmitted using the Websites, is excluded to the fullest extent permissible by law. In no event shall we be liable for any indirect loss, consequential loss, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with this agreement or use of the Websites save where such liability cannot be excluded by law.
8.3 We do not give any warranty that the Websites are free from viruses or anything else which may have a harmful effect on any technology.
9. Exclusion of liability for suppliers’ goods and services
9.1 We promote a number of suppliers on the Websites. We can accept no liability for any goods or services provided by third party suppliers and you should satisfy yourself that you wish to purchase those goods or services before contracting with the supplier. The suppliers will be supplying on their own standard terms and conditions and you should check that you agree to those terms and conditions before placing an order.
10. Username and password
10.1 On registering with us, you may be issued with a username and password which must be used in order to access certain restricted parts of the Websites. The username and password are personal to you and are not transferable.
10.2 Your username and password are the methods used by us to identify you and so are very important. You are responsible for all information posted on the Websites by anyone using your username and password and any payments due for services accessed through the Websites by anyone using your username and password. Any breach of security of a username and password should be notified to us immediately.
10.3 You may not adapt or circumvent the systems in place in connection with the Websites, nor access the Websites other than through normal operations.
11. Data protection
11.1 We are committed to protecting your privacy. We will collect and use information supplied by you and others to improve and personalise your experience as an Invitation member and when you visit the Websites. We may also use it to advise you and any friends you have introduced to us about changes in our services or about features we think you and your recommended friends may find interesting. By introducing a friend you are consenting for us to approach and communicate with them on your behalf. We do not sell, trade or rent your personal information to others.
11.2 Under the Data Protection Act 1998 we follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access.
11.3 You may edit your personal information at any time.
11.4 By submitting a friend’s contact details through Recommend-A-Friend, you consent for communications to be made to your friend (by phone, email or digitally) on your behalf using your email address and name from Spree Publications Ltd.
12. Cookies
A cookie is a small text file written to your hard drive that contains information. Cookies do not contain any personal information about users. Once you close your browser, the cookie simply terminates. We use cookies so that we can personalise your experience of the Websites. If you set up your browser to reject the cookie, you may still use the Websites. Some of our business partners use cookies on our site (for example, advertisers). We have no access to or control over these cookies.
13. Termination
13.1 We may terminate your access to the Websites, Spree App and the services within it at any time at our sole discretion. Any subscriptions that you have made will be deemed to be cancelled and you will receive a refund for any price paid by you for the Spree subscription.
13.2 All disclaimers, indemnities and exclusions in these terms and conditions shall survive termination of the agreement between us for any reason.
14. Complaints

15. General
15.1 If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.
15.2 We may modify these terms and conditions at any time by publishing the modified terms and conditions on the Websites. Any modifications shall take effect 3 days after posting on the Websites.
16. Governing law
16.1 These terms and conditions shall be governed by and construed in accordance with Scots law.
16.2 Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts, to which both parties submit.
Annex A
Membership Information
Your Spree App subscription purchase automatically entitles you to membership of Spree. You need to activate your membership before using your Spree App and other member benefits.
Activating Membership
Either:
1. Complete the Activation form at www.spreebook.com/register or
2. Telephone 01224 621000 (during regular office hours)
Once you have activated your membership you are a fully pledged Spree Member.
Additional Offers
As a Spree Member, you will receive additional savings, offers and promotions throughout the year. We may email you new merchants’ offers as they become available. To receive notification by email, please provide us with a valid email address when registering and ensure you check the box allowing us to contact you through email marketing.
Validity
Your Spree App and offer vouchers are valid until the 1st of October of each year.

Annex B
Spree App subscription Rules of Use
The Basics
Your Spree App is essential for you to enjoy the sensational offers from the leading restaurants listed in the Restaurant section(s) of your Spree App. There are three basic rules to remember when enjoying offers with your Spree App:
1. Check your voucher as some restaurants insist you MUST book your table in advance and mention you are a Spree Member at the time you make the reservation.
2. When ordering your meal, we recommend you mention your Spree Membership and your intention to redeem your Spree App offer.
3. You should present your Spree App voucher when requesting the bill as it will be required to calculate your final bill total, which will include your Spree Members’ discount.
4. Offers are subject to availability and cannot be used in conjunction with any other offer or special menu.
Validity
Your Spree App subscription is valid until the date shown on the offer and can be used at any time other than where exclusions are stated differently in the individual promotion terms and conditions. All restaurant offers exclude the following days: Christmas Eve; Christmas Day; New Year’s Eve; New Year’s Day; Mother’s Day; Father’s Day; Easter Day; Valentine’s Day. Many restaurants are extremely busy in December, therefore carefully check the terms & conditions when using an offer at this time. If in doubt, contact the participating restaurant directly.

When enjoying a two for one offer, the participating restaurant will deduct the least expensive item from your bill.
% off offers
When enjoying a ‘% off’ offer, the restaurant will deduct the offer % from either the food bill or the final bill, as stated in the individual promotion (up to any maximum value indicated on the offer). If more than one Spree Spree App voucher is used, the % remains the same but the maximum saving is the combined value of the vouchers.
Dining in Groups
When dining in groups of up to six, you can use up to three Spree App Vouchers per offer, depending on what is stated on the voucher.
